2. REQUIREMENTS TO PROVIDE YOUR PERSONAL DATA

2.1. Minimum age. You must be at least 18 years old and have sufficient legal capacity to use this Site in order to provide us with Your personal data. This Site is not directed to minors, nor does Tree-Nation knowingly collect data from them.

Identification and contact information. We collect your identifying information (first name and, optionally, last name), e-mail address, if you are communicating as an individual (citizen). In case you are sending communications on behalf of a Company, We collect the name of the contact person, the Company Name or project owner, and any other information you voluntarily include in the body of the message.

We may request additional information from You if necessary to fulfill your request.

Required fields will be indicated with an asterisk or similar notation. Without this information, We may not be able to address your requests.

Purpose

To answer your requests. The main purpose of the processing of this data will be to answer your requests, resolve your queries and/or provide you with the required information, as well as, where appropriate, to follow up on your requests.

Chat support on the Site may be provided by automated software (bots) during offline hours. These bots analyze the keywords used in your communications and respond with relevant information available on the Site.

Improving Customer Service. All the information derived from the doubts, queries, and advice offered to You, is anonymized at the end of the retention period indicated below, and allows us to know how We provide our own customer service, enabling us to improve its quality

3.2 Registration and Account Creation

How We collect data

• Registration form "Join Tree-Nation" or "Sign up"
• In addition to email registration, You may register or log in via third-party platforms or social networks (Google -including "Sign in with Google" and Google One Tap, Facebook and potentially iCloud). When You choose this option, the relevant provider will request Your consent to share certain account data with Tree-Nation. We do not receive Your passwords.

Data collected

Basic registration data:

Identifying and contact information. When you register on Our Site, you must fill in a form that requires certain information:

• Registration as an individual (citizen): We request your name and surname, e-mail address, and password.
• Registration as a Company: We request the name of the contact person, Company Name, e-mail address (website and phone are optional) and password.

Registration through Social Networks or Other platform. If you decide to register or log in via a third-party platform or social network, such as Facebook, Google or iCloud, We will have access to certain information from your public social network account, including your name and other profile information. At the time of registration, the social network will inform you about the data that will be transmitted to us for registration and will indicate the conditions.

Please note that the data you provide on such platforms will be processed in accordance with the terms and conditions of the relevant platform or social network. We encourage you to stay informed about the purpose and scope of the collection carried out by these platforms.

Employment Details: If you register as a Company, We may collect data relating to the contact person representing the company (name and surname, professional e-mail address, link to the company's site, position and/or department).

Additional information: When you create a profile on Our Site, We request for personal information, which you may provide voluntarily, i.e. location, phone number, birthday, photo (avatar), and any additional information you wish to add.

Data we collect when you use the different spaces available through the Site:

User-Generated Content and Interactions. Our Site revolves around user participation in reforestation projects. Our Tree Feed is where users engage with one another's reforestation efforts. We collect and use the following information to populate this space:

• Details of the trees planted when you collaborate in Our reforestation Projects, including species, real-world location, and associated causes.
• Posts, captions, and any multimedia you upload and share.
• When you like, comment, or use "Replant" (our repost function that lets you support others' causes), this interaction is visible to other users.

Content posted by You and other users of the community may also be shared on social media through the sharing options available on Our Site, such as share buttons or by copying and reposting links. Please note that any data you provide through these social media platforms will be processed according to the terms and conditions of the respective platform. We encourage You to review the privacy policies of these platforms to understand how Your information is collected and used. You can manage your privacy preferences, including whether other users may Replant (share) your trees, through your profile settings. If you deactivate this option, your trees cannot be replanted by other users.

Usage Data: We collect data on how You use Our Site. In particular:

• Interaction Data: Pages visited, features used, and time spent on the Site.
• Device Information: Device type, operating system, browser type, and IP address.
• Log Data: Access times, pages viewed, and referring URL

Purpose

1. Signing up, creating and customizing your profile, managing your account, and enabling you to participate in and benefit from the core objectives and functionalities of the Site.

The primary purpose of processing Your personal data is to register You as a user on Our Site and enable You to access and use the features available to registered users. These features include:

• Creating and customizing your user profile, including adding a display name, profile photo, and personal bio;
• Collaborating in Our Project(s), as explained in Section 3.4.;
• Posting and sharing content about your reforestation activities, including text, images, videos, and updates visible in the community Feed.
• Engaging with other users by liking, commenting on, or Replanting their posts to show support and expand the reach of shared causes.
• Participating in games, campaigns or challenges aimed at raising awareness or achieving collective tree-planting goals.

Please note that all the content You share on the Site is visible to other users. We strongly advise against publishing any personal, sensitive, or confidential information that You do not wish to make public.

2. To provide you with content (e.g., articles, tips, stories, and experiences) created by Us or in collaboration with trusted third parties, designed to educate and engage users in reforestation and sustainability.

3. Sending newsletters or commercial communications. Where you have explicitly given your consent by ticking the relevant box(es). In such cases, your data will be processed in accordance with Section 3.3 of this Privacy Policy.

4. To ensure the proper functionality and security of the Site, including:

• Detecting, preventing, and addressing unlawful or unauthorized activity (e.g., spam, fraud, denial-of-service attacks, or account misuse).
• Enforcing our Terms of Use and maintaining the integrity of the Site.
• Monitoring system performance and gathering statistical information to improve the technical and user experience aspects of the Site.

Please note that content You have posted publicly on the Site (such as tree contributions, comments, etc.) may continue to be visible to other users even after You delete Your account, unless You request its removal and it is not necessary to retain it for compliance or legitimate interest purposes.

The content You share on the Site, such as posts, comments, and other interactions as described in this Section, is public and visible to other users. Additionally, this content may be accessible through web browsers and may appear in search engine results, meaning it can be viewed by anyone, even those who are not logged in to the Site.

Please note that users can also capture and share content, and links to media shared on the Site, which may remain accessible to anyone with the link.

Apart from the visibility of your content as described above, We share Your personal data only as outlined in Section 4 of this Privacy Policy.

3.3 Newsletter and Commercial Communications

Identification and contact details: In order to send commercial information by electronic means, we use the identification details (name) and e-mail address.

Purpose

Sending you publications and commercial communications related to our Services: We may send You, by electronic means, our newsletter and other commercial communications related to our Services.

Consent. The processing of Your data for this purpose is based on your consent, requested at the time of registration by ticking a corresponding box on the contact form.

You can unsubscribe from these commercial communications at any time through the mechanism indicated in each email or by sending us an email to contactus@tree-nation.com

Retention period

We will keep the information for as long as you are registered on our distribution list for this type of information and, once you unsubscribe, it will be blocked for the legal periods foreseen in order to attend to possible responsibilities.

We do not share your personal information for processing purposes, except as outlined in Section 4.

3.4 Tree-Gifting and Acquisition of Services

How We collect data

• "Plant a Tree", "Offer a Tree" or acquiring any of Our Services from Our Site

Data collected

User Information. To support any of Our Projects, plant trees, offer trees to third parties, or acquire any of Our Services, you must be registered as a User on our Site. Therefore, registration as a User is necessary to carry out the actions indicated above and acquire any of Our Services. For more information on what data we collect and how we process it when You register as User, please refer to Section 3.2.

Transaction Data. All orders are payable by credit card and processed through Our external payment service provider or via bank transfer. This provider will receive Your name and bank details to complete the payment and will notify us once it is processed. We do not store your payment information. However, We process transaction data (such as payment date, processing date, and amount) for reporting and compliance purposes, and retain it for five to ten years along with your identification data.

Purpose

Performance of the contract to which you are a party. Tree-Nation allows individuals and companies to support Our mission by planting trees, offering them to others, or using Our Services in connection with selected reforestation projects ("Projects").

When you take part in any of these activities, we need to process Your personal data to fulfill Our obligations to You. This includes: Processing payments, and handling administrative, tax, accounting, and customer service matters. We may also send You important updates, such as changes to Our terms and conditions, security notices, or other information relevant to Your use of Our Site and Services.

Offer a Tree. If you choose to offer a tree to someone else, you have two options:

• Anonymous Option: You may send the tree-gift using a dedicated link (tree-gift URL) without providing the recipient's email address. In this case, We do not collect or store any personal data of the recipient.
• Email Option: Alternatively, You may ask Us to send the tree-gift directly via email. In this case, You will need to provide the full name and email address of the recipient. This information is processed exclusively for the following purposes:
  • To deliver the tree-gift email to the intended recipient.
  • To send up to two reminder emails: one 48 hours after the initial message, and a second 10 days later if the gift has not yet been claimed.
  • To allow the recipient, should they register later, to retrieve any trees previously gifted to them.

Please note: This data is stored securely in Our database and will not be used for any purposes other than those outlined above. We do not use recipient information for marketing, profiling, or any unrelated activities.

Legal basis

Performance of a Contract. We process Your data because it is necessary to fulfill the contract between You and Us. All the information We collect and process for the purposes described above is essential for Us to provide Our Services. Without this data, We would not be able to deliver the requested Services or carry out related administrative tasks.

Any information that is mandatory for the performance of the contract will be clearly marked with an asterisk (*) or similar indication during the data collection process. If you choose not to provide this required information, we may be unable to process your requests, or provide access to certain Services.

If you choose to share personal data belonging to a third party (such as their email address to send them a tree gift), You confirm that You have obtained their prior consent to share this information with Us.

Retention period

We will retain your personal data for as long as Your account remains active or as long as it is necessary to provide you with Our Services and fulfill the purposes outlined in this Section. If you request the deletion of Your account or no longer use Our Services, Your data will be securely blocked and retained only for the legally required periods, in order to address potential liabilities and to demonstrate Our compliance with applicable obligations.

For data related to transactions (such as purchases or donations), we are legally required to retain the relevant records for up to ten (10) years for accounting and tax purposes.

3.5 Purchase of Products from Our Online Shop

When You place an order through Our Site, We collect the following types of personal data:

• Identification and Contact Information. This includes Your full name, email address, postal address, and any other contact details required to fulfill Your order.

Once this relationship ends, the data will be securely blocked and retained for the legally established periods, solely to address potential liabilities and demonstrate compliance with Our legal obligations. For transaction information, it is stored in combination with your identification data and kept for a period of ten (10) years, in line with legal requirements for accounting and tax compliance.

3.6 Browsing the Site (Cookies)

• Google Sign-In / One Tap (Google LLC): Used to enable user authentication through Google accounts and remember returning users who have previously granted consent. These cookies are necessary to provide the login functionality securely.

TREE-NATION profiles in social networks

We have a profile on the main social networks such as Facebook, X (formerly Twitter), Instagram, and LinkedIn.

When You become a follower of any of Our pages on these social networks, the processing of Your data will be governed by the terms of use, privacy policies, and access regulations of the corresponding social network, which You have previously accepted.

In this context, We will process Your data for the purposes of properly managing Our presence on the social network, informing You of activities, products, or services, as well as for any other purposes permitted by the regulations of the social networks.

Please note that We have no influence over the information that the social network collects or how it processes it, so We recommend that You stay informed about the purpose and extent of the data collection through these social networks.

4. RECIPIENTS OF YOUR PERSONAL DATA

The specific transfers of personal data related to each processing activity are described in Section 3. In addition to those, the following transfers apply across all processing operations, along with their corresponding legal bases:

• Providers of services essential to the provision of the Service: We may share Your data with providers of services essential to the provision of the Service We offer You (for example, computer hosting companies or platforms for sending commercial communications). Notwithstanding the foregoing, these entities have signed confidentiality and other agreements with Us and will only process Your data in accordance with Our instructions. 5. ARE YOUR PERSONAL DATA TRANSFERRED TO THIRD COUNTRIES OUTSIDE THE ECONOMIC AREA?

Some of our service providers are located in countries outside the European Economic Area ("EEA").

Right to withdraw consent

You may withdraw your consent in relation to all processing based on your consent at any time. However, withdrawal of consent will not affect the lawfulness of the processing based on the consent prior to its withdrawal.

7. PROTECTION OF YOUR PERSONAL INFORMATION

The security of your personal data is a priority for us. For this reason, We have implemented all the necessary security measures to guarantee the effective use and processing of the personal data provided by the user, safeguarding the privacy, confidentiality and integrity of the same and making use of the necessary technical means to avoid the alteration, loss, unauthorized access or processing of your data, according to the state of technology at any given time.

Consequently, we comply with the security standards recommended to protect them. However, it is impossible to fully guarantee their security due to the nature of the Internet and because there may be malicious acts by third parties beyond our control.

We undertake to act promptly and diligently in the event that data security is compromised and to inform you if relevant.
